          Spousal support refers to payments made by one spouse to the other during a separation. Alimony refers to monthly payments made by one spouse to the other after a divorce. Spousal support or alimony in Pennsylvania may be awarded by the court in a divorce or separation proceeding. An award depends on many factors, such as the length of the marriage, the earning capacities of each spouse, and the financial resources available to each spouse.

          Alimony Pendente Lite refers to a form of alimony payable “pending litigation” and is also based on need. This type of spousal support is only payable during the pendency of the divorce proceedings.

          No-Fault or Uncontested Divorces

          In Pennsylvania, the term “no-fault divorce” refers to a divorce that may be obtained without regard to marital fault, i.e., guilt or innocence of either party. The primary issue in a no-fault divorce is whether the marriage is “irretrievably broken.” Irretrievably broken is defined in the Pennsylvania Domestic Relations Code as “estrangement due to marital difficulties with no reasonable prospect of reconciliation.”
